Terms of Service

These Terms of Service ("Terms") govern your use of the BackupApp desktop application and related services provided by BackupApp ("we," "our," or "us"). By purchasing, downloading, or using BackupApp, you agree to these Terms.

1. License Grant

Upon purchase, we grant you a personal, non-exclusive, non-transferable license to install and use BackupApp on up to three (3) computers that you own or control. This license is perpetual for the version purchased and includes free updates to minor versions.

2. Account and Activation

To use BackupApp, you must activate it with a valid license key. Each license key may be activated on a maximum of 3 machines. You are responsible for keeping your license key confidential. You may deactivate a machine at any time through the app's Settings to free up an activation slot.

4. Cloud Provider Services

BackupApp connects to third-party cloud storage services (Google Drive, OneDrive, Dropbox, S3-compatible providers). Your use of these services is governed by their respective terms of service. We are not responsible for the availability, reliability, or policies of third-party cloud providers.

You are responsible for maintaining valid accounts and sufficient storage space with your chosen cloud providers.

5. Your Data

BackupApp facilitates direct file transfers between your computer and your cloud providers. We do not access, store, or process your files. You retain full ownership of all data you back up or sync using BackupApp.

You are responsible for maintaining your own backups. While BackupApp is designed to be reliable, no software is perfect. We recommend maintaining redundant backups of critical data.

6. Payment and Refunds

BackupApp is sold as a one-time purchase. Payments are processed securely through Stripe. Prices are listed in USD and may be subject to applicable taxes.

We offer a 30-day money-back guarantee. If you are not satisfied with BackupApp within 30 days of purchase, contact support@backupapp.app for a full refund. After 30 days, purchases are non-refundable.

7. Updates

Your license includes free updates to minor versions (e.g., 1.0 to 1.x). Major version upgrades (e.g., 1.x to 2.0) may require a separate purchase or upgrade fee. We will provide reasonable notice before any paid upgrades.

8. Disclaimer of Warranties

BackupApp is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the software will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of or inability to use BackupApp.

Our total liability for any claim arising from these Terms or your use of BackupApp shall not exceed the amount you paid for the software.

10. Termination

We may terminate your license if you violate these Terms. Upon termination, you must uninstall BackupApp from all machines. Sections 8, 9, and 11 survive termination.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of BackupApp after changes constitutes acceptance.
